Terms and Conditions

In these terms and conditions, the following definitions apply:

• Jan de Belastingman: The user of these terms and conditions, located at De Lairessestraat 151, 1075 HK Amsterdam.
• Client: The natural person or legal entity entering into an agreement with Jan de Belastingman.
• Services: All work that Jan de Belastingman performs for the client, including but not limited to tax returns, tax advice and financial planning.
• Agreement: The arrangement between Jan de Belastingman and the client.

These terms and conditions apply to all offers, quotations and agreements of Jan de Belastingman, unless expressly agreed otherwise in writing.

Deviations from these terms and conditions are only valid if they have been expressly agreed in writing.

The applicability of any purchase or other conditions of the client is expressly rejected.

All offers and quotations from Jan de Belastingman are non-binding, unless expressly stated otherwise.

Prices in offers and quotations are exclusive of VAT, unless otherwise stated.

If the client has accepted an offer or quotation, Jan de Belastingman has the right to revoke it within 3 business days of receiving the acceptance.

Jan de Belastingman will execute the assignment to the best of its knowledge and ability and in accordance with the requirements of good workmanship.

Jan de Belastingman has the right to have certain work performed by third parties.

The client ensures that all data that Jan de Belastingman indicates is necessary or that the client should reasonably understand is necessary for the execution of the assignment is provided to Jan de Belastingman in a timely manner.

The fee is calculated based on the agreed rate or fixed amount.

Payment must be made within 14 days of the invoice date, unless otherwise agreed in writing.

In case of late payment, the client is automatically in default. The client then owes interest of 1% per month, unless the statutory interest is higher, in which case the statutory interest is due.

Jan de Belastingman is obliged to maintain confidentiality of all confidential information that has come to its knowledge in the context of the assignment.

Confidential information means all information from the client that has been designated as confidential or that Jan de Belastingman can reasonably know to be confidential.

Jan de Belastingman is only liable to the client for damage resulting from intent or gross negligence.

The liability of Jan de Belastingman is limited to the amount paid out by the liability insurance in the relevant case, plus the deductible according to the policy conditions.

Jan de Belastingman is never liable for indirect damage, including consequential damage, lost profits, missed savings and damage due to business interruption.

Both parties can terminate the agreement in writing at any time.

In case of termination by the client, Jan de Belastingman is entitled to compensation for all work performed up to that point according to the usual rates.

All intellectual property rights to materials developed or made available by Jan de Belastingman rest exclusively with Jan de Belastingman or its licensors.

The client only acquires the usage rights that arise from the agreement or that are expressly granted in writing.

All agreements between Jan de Belastingman and the client are exclusively governed by Dutch law.

Parties will only appeal to the court after they have made efforts to resolve a dispute through mutual consultation.

All disputes arising from or related to the agreement between parties will be submitted to the competent court in the district where Jan de Belastingman is located.

Jan de Belastingman reserves the right to change these terms and conditions.

Changes also apply to already concluded agreements with a period of 30 days after written notification of the change.
